Many businesses and self employed workers, especially those working in the small time don’t even think to trademark their ideas and/or logos because it seems like a pain to do something that probably won’t even come up for most people. Although the costs for trade marking something aren’t expensive, it is an expense that most people choose to put off for as long as possible in favor of more pertinent expenses. In fact, for a lot of people, trade marking do seem like a useless waste of time and money; after all, how likely is it that someone will steal your logo when you are a small time baker?
Trademarks though are like health insurance; you may never have to use it, but if you do have to use it, you’ll be glad to have it. Trademarks protect your intellectual property from being used freely by someone else, either for benign or malevolent purposes. Although many people won’t care about copycats who don’t profit from their ideas (such as using a picture as a model for a personal picture), they will care if people do profit from their ideas and the trademark can prevent copycats from stealing work. Trademarks are very useful for small business and entrepreneurs because they protect the owner from the advances of larger, unscrupulous businesses which may be quite willing to steal customers and clients from a smaller, unprotected business. So, even if you think it’s wildly unlikely that someone would profit from your ideas and/or logos, it’s still a good idea to get a trademark, just in case.Trademarks are not hard to get; you can apply through the United States Patent and Trademark Office and they are not expensive. There are three different kinds of trademarks: Registered trademarks which allow you to spread your trademark over wider areas, Unregistered trademarks which are bound geographically by borders determined by how likely you are to spread, and service marks which protect services. Trademarks last forever; unlike patents which have a shelf life of twenty years.
Although you may never actually need the trademark, it’s better to be safe than sorry. Protect your business from theft with a trademark.
